Weekly Address: Working Together to Extend the Middle Class Tax Cut; President Obama’s weekly address to the American people.

 

 

Hi, everybody.

Four years after the worst economic crisis of our lifetimes, our economy is growing again and creating jobs.  But we have much more to do. Our task now is to build on that progress.  Because this nation only succeeds when we’ve got a growing, thriving middle class.

That’s what drives me. That’s what I campaigned on for the past year.  That’s what will guide me in our work over the next four years. And I’m willing to work with anyone of any party to move this country forward.

Because soon, we face a very clear deadline that requires us to make some big decisions on jobs and taxes; on investments and deficits. Both parties voted to set this deadline. And I believe both parties can work together to make these decisions in a balanced and responsible way.

When it comes to taxes, for example, there are two pathways available.

One says, if Congress fails to act by the end of the year, then everybody’s taxes automatically go up – including the 98% of Americans who make less than $250,000 a year. Our economy can’t afford that right now. You can’t afford that right now.  And nobody wants that to happen.

The other path is for Congress to pass a law right away to prevent a tax hike on the first $250,000 of anyone’s income. That means all Americans – including the wealthiest Americans – get a tax cut.  And 98 percent of Americans, and 97 percent of all small business owners, won’t see their income taxes go up a single dime.

The Senate has already passed a bill like this. Democrats in the House are ready to pass one, too. All we need is for Republicans in the House to come on board.

We shouldn’t hold the middle class hostage while Congress debates tax cuts for the wealthy. Let’s begin our work by actually doing what we all agree on. Let’s keep taxes low for the middle class. And let’s get it done soon – so we can give families and businesses some good news going into the holiday season.

I know these challenges won’t be easy to solve. But we can do it if we work together.

That’s why on Friday I sat down with Congressional leaders to discuss how we can reduce our deficit in a way that strengthens our economy and protects our middle class. It was a constructive meeting. And everyone agreed that while we may have our differences, we need to come together, find solutions and take action as soon as possible.

Because if anything, that’s the message I heard loud and clear in the election.

Work as hard as you can to make our lives better. And do it together.

Don’t worry about the politics.  Just get the job done.

Everywhere I went in that campaign – from farms in Iowa to the Vegas strip; from Colorado’s Rockies to the Florida coast – I was inspired by the grit and resilience of the American people, by your hard work and sense of decency.  And it makes me want to work even harder for you. I saw it again this week in New York, where our fellow citizens are going through a really tough time, but are helping each other through it. And we’re going to be there to help them rebuild.

Every single day, the good people of this country work as hard as you can to meet your responsibilities. Those of us you sent to Washington are going to do the same.

The U.S. Supreme Court held 3 days of oral arguments about the multi-state lawsuit challenging the health care law. On March 26, 27 and 28 the Court Justices sat for a combined six hours to ascertain the constitutionality of the Patient Protection and Affordable Care Act. The case is officially referred to as Florida v. Department of Health & Human Services. Anti-Injunction Act On the first day, the Supreme Court heard one-and-a-half hours of oral arguments on the jurisdictional issue of whether the federal Anti-Injunction Act is applicable towards Affordable Care Act and if so, does the Court have jurisdiction. The Anti-Injunction Act prohibits the Courts from striking down tax laws before they take affect. Both the Administration and opposition counsel specified that this law does not constitute a tax, so the court took the unusual step of appointing an authorized to argue for the implementation of the Anti-Injunction Act Individual Mandate The individual mandate part of the law goes into effect on January 1, 2014. it mandates that nearly all Americans to obtain medical care insurance or pay a fine. On Tuesday, the Supreme Court heard two hours of oral argument on the mandate. Severability On the last day of oral argument, the Court considered if the rest of the health care law can stand in the event the individual mandate provision is found unconstitutional, known as severability. Adversaries of the law contend that if the mandate is stricken, the complete Health Care law ought to be struck down. While the government says that if the requirement is recognized as unconstitutional, only two major provisions of the law must fall, but the rest of the law can stand. Medicaid The last question before the Court was if the Affordable Care Act’s expansion of the Medicaid program violates the Constitution. Twenty-six states challenged the decision within the Affordable Care Act to expand Medicaid coverage; an expansion that the states claim will break their budgets. The states argue that federal Medicaid funding they rely on will be taken away if the states won’t accept this portion of the law. Defenders of the Medicaid expansion provision argued that states can determine whether they choose to participate in Medicaid on the terms detailed in the act. Background Before the Supreme Court oral arguments on March 26, 27 and 28, three different circuit courts listened to oral argument on the new health care law. In May 2011, the Fourth Circuit in Richmond, Virginia heard two cases on the health care law. In Liberty University v. Geithner, the Court decided 2-1 that the individuals in the case were not able to challenge the law until after the law is put into effect. And Virginia v. Sebelius, the court dismissed the case on the rationale that the only plaintiff in the case, the Commonwealth of Virginia, had no legal right to bring a lawsuit because the individual mandate impacts only individuals. The first appellate court with a decision on the law was the Sixth Circuit Court of Appeals in Cincinnati, Ohio in Thomas More Law Center v. Obama. The Court determined 2-1 to reject the Center’s argument that the individual mandate can never be constitutional, an argument known as a “facial challenge.” within the opinion by Judge Jeffrey Sutton, a conservative judge who clerked for Justice Antonin Scalia, the court held that it’s constitutional to have the need for all Americans to buy medical care insurance coverage. The next to listen to a challenge to the health care law was the Eighth Circuit Court of Appeals in Atlanta. That Court reached the exact opposite conclusion from the Sixth Circuit in the case brought by Florida together with a group of twenty-five other states, along with the National Federation of Independent Business (NFIB). The Court sided with the challengers that the individual mandate is unconstitutional. Nonetheless, the court also held that even if the individual mandate was unconstitutional, the rest of the health care law could still go into effect, a legal concept known as “severability.” The 26 States in the court action before the Supreme Court are: Alabama, Alaska, Arizona, Colorado, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Maine, Michigan, Mississippi, Nebraska, Nevada, North Dakota, Ohio, Pennsylvania, South Carolina, South Dakota, Texas, Utah, Washington, Wisconsin and Wyoming.

WASHINGTON, DC – Today, President Barack Obama announced his intent to nominate the following individuals to key Administration posts:

• Frederick “Rick” Barton – Assistant Secretary for Conflict and Stabilization Operations and Coordinator for Reconstruction and Stabilization, Department of State
• Arun Majumdar – Under Secretary of Energy, Department of Energy
• Marie F. Smith – Member, Social Security Advisory Board

The President also announced his intent to appoint the following individuals to key administration posts:

• Barbara K. Rimer – Chairman, President’s Cancer Panel
• Owen N. Witte – Member, President’s Cancer Panel

President Obama said, “These men and women have demonstrated knowledge and dedication throughout their careers.  I am grateful they have chosen to take on these important roles, and I look forward to working with them in the months and years to come.”

President Obama announced his intent to nominate the following individuals to key Administration posts:

Frederick “Rick” Barton, Nominee for Assistant Secretary for Conflict and Stabilization Operations and Coordinator for Reconstruction and Stabilization, Department of State
Frederick “Rick” Barton currently serves as a Senior Advisor to the Secretary of State.   From December 2009 to October 2011, he served as the U.S. Representative to the Economic and Social Council of the United Nations in New York with the rank of Ambassador.  Prior to this role, Mr. Barton was a Senior Adviser and Co-Director of the Post Conflict Reconstruction Project at the Center for Strategic and International Studies.  He was also Co-Chair of a working group on Stabilization and Reconstruction at the United States Institute of Peace, Co-Chair of the Princeton Project on National Security’s Working Group on Reconstruction and Development and an expert adviser to the Iraq Study Group and the Task Force on the United Nations.  From 1999 to 2001, he served as the United Nations Deputy High Commissioner for Refugees in Geneva.  Mr. Barton was the founding Director of the Office of Transition Initiatives at the U.S. Agency for International Development, serving from 1994 to 1999.  Prior to this, Mr. Barton was President of Barton & Gingold, a strategy and public relations firm in Portland, Maine from 1983 to 1994.  He served as New England Director of Public Affairs for the U.S. Department of Health and Human Services from 1978 to 1981.  A graduate of Harvard College, Mr. Barton earned a Master’s in Business Administration from Boston University, with an emphasis on Public Management.

Dr. Arun Majumdar, Nominee for Under Secretary of Energy, Department of Energy
Dr. Arun Majumdar has served as the Director of the Advanced Research Projects Agency-Energy (ARPA-E) since 2009. Previously, he was Associate Laboratory Director for Energy and Environment at Lawrence Berkeley National Laboratory and a professor of mechanical engineering and materials science and engineering at the University of California, Berkeley. His research career has focused on the science and engineering of energy conversion, transport, and storage, ranging from the molecular and nanoscale level to large energy systems. He has served on the advisory committee of the National Science Foundation’s engineering directorate and the President’s Council of Advisors on Science and Technology. Dr. Majumdar was elected a member of the National Academy of Engineering in 2005. He received his Bachelor’s degree in Mechanical Engineering from the Indian Institute of Technology, Bombay in 1985 and his Ph.D. in 1989 from the University of California, Berkeley.

Marie F. Smith was the President and Spokeswoman for the AARP, formerly the American Association for Retired Persons, between 2004 and 2006. She was elected and served as President-elect of the AARP in 2002 until 2004, and previously served as Treasurer of the AARP Foundation Board of Directors, Chair of the AARP National Legislative Council, and a Spokesperson for the AARP’s Women’s Initiative Program. Before her time at the AARP, Ms. Smith spent twenty-five years with the Social Security Administration (SSA), holding several senior positions there, including Director of Manpower Management. She began at the SSA as a claims representative. Ms. Smith earned a B.S. from Fisk University.

Dr. Barbara K. Rimer, Appointee for Chairman, President’s Cancer Panel
Dr. Barbara K. Rimer is the Dean and Alumni Distinguished Professor at the Gillings School of Global Public Health, University of North Carolina (UNC) at Chapel Hill, positions she has held since 2005 and 2003, respectively.  She is also a member of the Lineberger Comprehensive Cancer Center at UNC.  From 1997 to 2002, Dr. Rimer served as Director of the Division of Cancer Control and Population Sciences at the National Cancer Institute.  Previously, she held leadership positions at Duke University Medical Center in Durham, NC and the Fox Chase Cancer Center in Philadelphia, PA.  Dr. Rimer has served on a number of boards, including the Task Force on Community Preventive Services, AFLAC’s board of directors, and as the first woman to chair the National Cancer Institute’s National Cancer Advisory Board.  Dr. Rimer is a recipient of the Director’s Award from the National Institutes of Health and the American Cancer Society’s Distinguished Service Award.  She was elected to the Institute of Medicine in 2008.  Dr. Rimer holds a B.A. and M.P.H. from the University of Michigan and a Dr.PH. from the Johns Hopkins Bloomberg School of Public Health.

Dr. Owen N. Witte, Appointee for Member, President’s Cancer Panel
Dr. Owen N. Witte has been Director of the Eli and Edythe Broad Center of Regenerative Medicine and Stem Cell Research at the University of California at Los Angeles (UCLA) since 2007.  From 2005 to 2007, he served as the Founding Director of the Institute for Stem Cell Biology and Medicine at UCLA.  Dr. Witte first joined the faculty of UCLA in 1980, becoming the David Saxon Presidential Chair in Developmental Immunology in 1989, and a Distinguished Professor in 2004.  In addition, Dr. Witte has been an Investigator at the Howard Hughes Medical Institute since 1986.  Dr. Witte has served on a number of boards, including the American Association for Cancer Research.  He is also a member of the National Academy of Sciences, the American Academy of Arts and Sciences, and the Institute of Medicine.  Dr. Witte holds a B.S. in Microbiology from Cornell University and an M.D. from Stanford University School of Medicine.

Clyburn sent a letter today to Speaker John Boehner calling on him to ensure passage of three pieces of essential legislation prior to the end of the year, either as part of the CR or as freestanding bills:

• Extension of Unemployment Insurance for those who lost their jobs through no fault of their own.

• Extension and expansion of the Payroll Tax holiday that would ensure that virtually every working American receives a tax cut.

• Extension of the SGR to ensure that millions of seniors do not lose access to their Medicare physicians.

As the Democratic leaders wrote, “independent economists from across the political spectrum estimate that failure to pass these essential pieces of legislation could reduce economic growth by ¬¬as much as 2 percentage points next year.”

Pelosi, Hoyer and Clyburn assured Boehner of their commitment to passing a bipartisan Continuing Resolution.

WASHINGTON—In this week’s address, President Obama spoke from Indonesia and told the American people that during his trip to the Asia Pacific, he has made progress opening up markets to support thousands of American jobs and keep us on track to double American exports by 2014.  The President’s trip underscores his belief that our businesses will always be successful competing around the world and that he will continue to do everything possible to create jobs for the American people.

Today, I’m speaking to you from Indonesia as I finish up my trip to the Asia Pacific – the region where we do most of our trade and sell most of our exports.  And over the past week, the progress we’ve made in opening markets and boosting exports here will help create more jobs and more growth in the United States.

Here in Indonesia, I was proud to join leaders from some of our nation’s top companies as they announced trade deals that will support nearly 130,000 American jobs and potentially increase U.S. exports by up to $39 billion.  Boeing, for example, will sell more than 200 planes to Indonesia that are built with parts from suppliers in more than 40 states.  And a deal to export GE engines will support jobs at plants in Ohio and North Carolina.

These agreements will help us reach my goal of doubling American exports by 2014 – a goal we’re on pace to meet.  And they’re powerful examples of how we can rebuild an economy that’s focused on what our country has always done best – making and selling products all over the world that are stamped with three proud words:  “Made In America.”

This is important, because over the last decade, we became a country that relied too much on what we bought and consumed.  We racked up a lot of debt, but we didn’t create many jobs at all.

If we want an economy that’s built to last and built to compete, we have to change that.  We have to restore America’s manufacturing might, which is what helped us build the largest middle-class in history.  That’s why we chose to pull the auto industry back from the brink, saving hundreds of thousands of jobs in the process.  And that’s why we’re investing in the next generation of high-tech, American manufacturing.

But building an economy that lasts isn’t just about making things – it’s about opening new markets for people to buy them.  After all, 95% of the world’s consumers live outside our borders.  And as the fastest-growing region in the world, no market is more important to our economic future than the Asia Pacific – a region where our exports already support five million American jobs.

This is why we recently signed a landmark trade agreement with South Korea that will support tens of thousands of American jobs.  And it’s why I traveled here this week.  In Hawaii, I hosted leaders from across the Asia Pacific, and we agreed to make it easier for American companies to do business overseas.  I also worked with President Medvedev of Russia to pursue trade that would increase exports and jobs for American manufacturers and farmers.  And working with other leaders, we made progress toward our most ambitious trade agreement yet – a partnership with Pacific nations that holds the potential for more exports and more jobs in a region of nearly three billion consumers.

We may be going through tough times, but as I’ve said time and time again, the United States still has the world’s most dynamic economy, the finest universities, the most innovative companies, and the hardest-working people on Earth.  We can compete against anybody – and we can win.  As President, I intend to make sure that happens by doing everything I can to give American workers and businesses the chance to succeed.
